If you have been denied benefits at this point, it is your right to request a hearing before an Administrative Law Judge. Here you will be able to present evidence that supports your claim. This evidence must prove that you have a medical condition that is disabling and prevents you from working AND that there is not any other work available in the job market that you would be able carry out. Additionally, the evidence presented must establish the severity and duration of your disability.

If you are not awarded benefits after your initial administrative hearing, you may appeal the denial of your claim to a second level and then if all else fails, to the United Stated District Court for the district in which you live. This will involve a trial before a federal judge and all Rules of Evidence apply.
